Terms of Service

These Terms of Service and End-User License Agreement (the “Terms”) are a binding agreement between you and Listed App LLC (“Listed,” “we,” “us”) governing your use of the Listed mobile application and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use Listed. By using the Service you represent that you are 18 or older and that you are able to form a binding contract with us.

2. The Service

Listed lets you create and RSVP to events, carry a check-in pass, build a friends list through mutual friend requests, opt in to Connect to discover and match with people at events you share, and message people one-to-one and in event group chats. Some direct messages are ephemeral and disappear after both people open them or within 24 hours. Features may change, and we may add, modify, or discontinue parts of the Service.

3. Your account

Listed uses passwordless sign-in: we send a one-time code by SMS or email, and that code is your credential. You are responsible for keeping access to your phone, email, and device secure, and for all activity under your account. Notify us promptly at support@listed.events if you believe your account has been compromised.

4. Acceptable use — zero tolerance for objectionable content

We have zero tolerance for objectionable content and abusive behavior. You agree not to post, send, or share content, and not to engage in conduct, that:

• is harassing, threatening, hateful, defamatory, or bullying;
• is sexually explicit, pornographic, or exploits or endangers minors;
• is violent, promotes self-harm, or incites illegal activity;
• is spam, fraudulent, deceptive, or impersonates another person; or
• infringes anyone’s intellectual-property, privacy, or other rights.

Objectionable content and abusive users are not tolerated. We may remove content, and suspend or terminate accounts, that violate these rules — and we act on reports promptly.

5. Your content

You retain ownership of the content you create (your profile, events, and messages). You grant us a limited, non-exclusive, worldwide license to host, store, display, and transmit that content solely to operate and provide the Service. You are solely responsible for your content and represent that you have the rights to share it.

6. Blocking, reporting, and enforcement

You can block any user from their profile, and report users or content that violate these Terms. Reports are reviewed, and content on Listed is subject to automated and human moderation. We may remove content, limit features, or suspend or terminate accounts at our discretion to keep the community safe. Blocked users cannot see your content or contact you.

7. Events

Listed is a platform for organizing and discovering events; we are not the organizer of, and are not responsible for, any event, venue, host, or the conduct of attendees. Hosts are solely responsible for their events. You attend events at your own risk and are responsible for your own safety and conduct.

8. Identity verification & payments

Verification (the blue check) is optional and offered as a one-time purchase of $12.99 through Apple’s In-App Purchase. Payment is charged to your Apple account, and the purchase is a digital good that is generally non-refundable except where required by law or Apple’s policies. All refund requests are handled by Apple. Verification is processed by Stripe Identity as described in our Privacy Policy.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any information (including other users’ profiles) is accurate.

10. Limitation of liability

To the maximum extent permitted by law, Listed and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50.

11. Indemnification

You agree to indemnify and hold harmless Listed and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or the rights of any third party.

12. Termination & account deletion

You may stop using the Service and delete your account at any time from Settings → Delete account. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Provisions that by their nature should survive termination will survive.

13. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

14. Apple App Store terms

The following applies because you obtained the app through the Apple App Store:

• These Terms are an agreement between you and Listed only, not with Apple. Listed — not Apple — is solely responsible for the app and its content.
• Your license to use the app is a non-transferable license to use it on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to furnish any maintenance or support services for the app.
• Apple is not responsible for any product warranties, whether express or implied. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claims by you or a third party relating to the app, including product-liability, legal or regulatory, and intellectual-property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect means you accept the updated Terms.
